These Terms of Service ("Terms") govern your access to and use of Serwen, an AI assistant platform and related services provided by Omalius BV, a company incorporated under Belgian law, with registered office in Hasselt, Belgium ("Serwen", "we", "us", or "our").
By accessing or using Serwen, creating an account, subscribing to a paid plan, purchasing credits, or otherwise using the service, you agree to these Terms.
If you do not agree to these Terms, you must not use Serwen.
If you use Serwen on behalf of a company, organization, association, or other legal entity, you confirm that you have the authority to bind that entity to these Terms. In that case, "you" and "your" refer to both you and the entity you represent.
Serwen provides access to AI-powered tools, including but not limited to chat, web search, productivity assistance, custom experts, automation-related features, and related software services.
The exact features available to you may depend on your plan, subscription, account type, region, usage limits, technical availability, and any additional conditions displayed at the time of purchase or use.
Serwen may be used by individuals, professionals, freelancers, companies, and organizations, subject to these Terms and applicable law.
We may improve, modify, replace, suspend, or discontinue parts of the service from time to time. Where required by law, we will take reasonable steps to inform affected users of material changes.
There is no fixed minimum age requirement in these Terms.
However, by using Serwen, you confirm that you have the legal capacity required under applicable law to accept these Terms and use the service.
If you do not have such legal capacity, a parent, legal guardian, or authorized representative must review and accept these Terms where legally required.
You are responsible for ensuring that your use of Serwen is lawful in your country, region, professional context, and organization.

Serwen does not provide legal, medical, financial, tax, accounting, investment, psychological, engineering, security, or other regulated professional advice.
Any information generated through Serwen is provided for general informational and productivity purposes only.
You should consult a qualified professional before making decisions that may affect your rights, finances, health, legal obligations, business, security, or compliance position.
You must not use Serwen as the sole or primary basis for high-risk decisions or activities, including but not limited to:
You are responsible for ensuring that any use of Serwen in professional, regulated, or high-impact contexts complies with applicable law and includes appropriate human review.
Some features of Serwen may be free. Other features may require a paid subscription, paid credits, usage-based fees, or another paid plan.
Prices are displayed before purchase.
Unless stated otherwise, prices may be displayed exclusive of applicable taxes, including VAT.
For consumers, where legally required, the total price including applicable taxes will be displayed before purchase.
We may change prices from time to time. Price changes apply prospectively and will not affect the current paid billing period unless otherwise stated or required by law.
Payments are processed through our payment provider, such as Stripe or another provider displayed at checkout.
By subscribing or purchasing paid services, you authorize Serwen and its payment provider to charge your selected payment method for the applicable fees, taxes, renewals, and other charges disclosed at purchase.
You are responsible for ensuring that your payment information is accurate and up to date.
Subscriptions are billed in advance on a recurring basis, such as monthly, yearly, or as otherwise specified at purchase.
Unless you cancel before the renewal date, your subscription will automatically renew at the end of each billing period and your payment method may be charged again.

You remain responsible for any unpaid amounts, unless the charge was made in error or is otherwise not legally payable.
Serwen may offer subscription credits, purchased credits, or usage-based credits.
Unless otherwise stated at purchase:
We may correct credit balances in case of technical errors, abuse, fraud, or incorrect allocation.
You may cancel your Serwen subscription at any time from your account settings, if available, or by contacting us at contact@serwen.com.
When you cancel a subscription, your access to paid features will usually continue until the end of the current billing period. After that period, your subscription will not renew and you will not be charged again.
Unless required by applicable law, cancellation does not automatically entitle you to a refund for the current billing period.

You grant Serwen a limited, non-exclusive, worldwide license to host, process, transmit, display, and use your content solely as necessary to:
We do not use your content to train AI models unless we clearly state otherwise and obtain any consent required by applicable law.
AI outputs may not be unique. Other users may receive similar or identical outputs.
You are responsible for determining whether an output is suitable for your intended use.

We do not guarantee that outputs are accurate, lawful, non-infringing, appropriate, secure, or suitable for any particular purpose.
Serwen, its software, interface, design, branding, logos, documentation, systems, workflows, databases, and underlying technology are owned by Omalius BV or its licensors and are protected by intellectual property laws.
These Terms do not transfer any ownership rights in Serwen to you.
You may not copy, modify, distribute, sell, lease, sublicense, reverse engineer, decompile, disassemble, or create derivative works from Serwen or any part of the service unless expressly permitted by law or by written authorization from us.
You may not use our name, logo, branding, or trademarks without our prior written consent.
Serwen may rely on or integrate with third-party services, including but not limited to:
Your use of third-party services may be subject to additional terms, privacy policies, technical limitations, and availability constraints imposed by those third parties.
We are not responsible for third-party services, except where required by applicable law.
Serwen is designed to prioritize European hosting, European infrastructure, and GDPR-aligned processing.
Our core application infrastructure and primary databases are hosted in Europe.
Serwen's AI model inference is provided through European cloud infrastructure. We aim to process AI requests within Europe where technically and commercially reasonable.
Our AI infrastructure providers are selected with attention to data protection, security, reliability, and GDPR alignment. We require appropriate contractual and technical safeguards from providers that process data on our behalf.
Serwen does not use your prompts, uploaded content, files, messages, or AI outputs to train AI models unless we clearly state otherwise and obtain any consent required by applicable law.
However, Serwen may also rely on other third-party providers for services such as payment processing, email delivery, analytics, monitoring, security, customer support, hosting management, or infrastructure operations.
Some of these providers may process limited personal data outside the European Union or European Economic Area where necessary to provide, secure, monitor, or improve the service.
Where personal data is transferred outside the European Union or European Economic Area, we rely on appropriate safeguards required by applicable data protection law, such as adequacy decisions, Standard Contractual Clauses, contractual protections, or other lawful transfer mechanisms.

If you use Serwen in a business or professional context, you are responsible for ensuring that you do not submit confidential, sensitive, regulated, or third-party information unless you have the right to do so.
You should not submit information that is subject to special legal, contractual, or professional confidentiality obligations unless you have verified that your use of Serwen is appropriate for that information.
Serwen will take reasonable technical and organizational measures to protect information submitted through the service, but you acknowledge that no online service can be guaranteed to be completely secure.
We process personal data in accordance with our Privacy Policy and applicable data protection laws, including the General Data Protection Regulation, known as the GDPR.
Depending on how you use Serwen, we may act as a data controller, data processor, or both.

If you use Serwen for business, professional, or organizational purposes, you agree to indemnify and hold harmless Omalius BV from claims, damages, losses, liabilities, costs, and expenses arising from:
This clause applies only to the extent permitted by applicable law.
If you are a consumer, you benefit from any mandatory consumer protection rights granted by Belgian law, European Union law, or the law of your country of residence where applicable.
Nothing in these Terms limits or excludes mandatory consumer rights that cannot legally be waived or limited.
In case of conflict between these Terms and mandatory consumer protection law, the mandatory consumer protection law will prevail.

We will not make unfair unilateral changes without a valid reason where this would violate applicable consumer protection law.
You may not transfer or assign your rights or obligations under these Terms without our prior written consent.
We may transfer or assign our rights and obligations under these Terms in connection with a merger, acquisition, restructuring, sale of assets, transfer of business, or legal reorganization, provided this does not reduce your mandatory rights under applicable law.
If any provision of these Terms is found to be invalid, unlawful, or unenforceable, the remaining provisions will remain in effect.
The invalid provision will be interpreted or replaced to the extent necessary to achieve its intended purpose in a lawful and enforceable way.
If we do not enforce a provision of these Terms immediately, this does not mean that we waive our right to enforce it later.
Any waiver must be explicit and in writing to be effective.
These Terms, together with any documents expressly referenced in them, including the Privacy Policy and any applicable payment or subscription terms, form the entire agreement between you and Serwen regarding your use of the service.
They replace any prior agreements or understandings relating to the same subject matter.
These Terms are governed by the laws of Belgium.
Subject to mandatory consumer protection rules, any dispute relating to these Terms or Serwen shall be submitted to the competent courts of Hasselt, Belgium.
If you are a consumer, you may also benefit from mandatory jurisdiction and consumer protection rights under the laws of your country of residence.
